Andrzej Wróbel. 4 Samorząd Terytorialny 1–2/2016 TA B L E O F CO N T E N T S & A B S T R A C T S Territorial Self-Government Scientific and Professional Monthly ARTICLES Jerzy Korczak Courses of change in legal regulations constituting grounds for the functioning of the municipality – from the point of view of the 25th anniversary of territorial self-government ....5 The twenty-fifth anniversary of the restitution of territorial self-government was an opportunity for many analyses and summaries on different planes of perceiving the place of territorial self-government in the structure of the State and the category of its tasks. One of the common elements of these studies is the volatility of the provisions of the law, but this is not a key issue for them, while such a long period of operation of one of the most important institutions of the State in the post-transformation period even encourages a review of the reasons for the volatility of the legal grounds of the functioning of territorial self-government units and its rate of change. In the publication, the author attempts to perform a greater cross-sectional analysis, the purpose of which is to determine the scope of changes, their subject matter and character and, finally, the consequences of the structure of the municipality, its tasks and the forms in which they are fulfilled. Sienkiewicz Legal and organizational transformations of municipal management in Poland after 1989...........35 The objective of the article is to analyse the evolution of the functioning of municipal management in Poland after 1989, on the legal, organizational and functional levels. The issues discussed in the article apply, in particular, to the organizational and legal changes in this area, which have taken in over the past twenty-five years. The studies also apply to the analysis of the basic problems and perspectives of the functioning of specific solutions in the area of municipal services. Agata Barczewska-Dziobek Cooperation between territorial self-government units and NGOs – genesis of solutions............ 48 Cooperation between territorial self-government units and non-governmental organizations in Poland finally became settled in 2003 by the provisions of the Act on public benefit activities and volunteering. The Act has introduced the necessary definitions, as well as principles and forms of cooperation; it has also defined the subject matter of cooperation between the public sector and non-governmental sector in the interests of public benefit. Even so, before these regulations were laid down, many solutions appeared throughout the country based on the structural regulations of territorial self-government units. The article contains a presentation of the acts of local law created during the period before the validity of the regulation putting order to this matter. Justyna Kuśnierz-Chmiel Legislative initiative of the inhabitants of the voivodship ...................................................................... 63 The objective of this article is to draw attention to the particular form of direct democracy, which is the legislative initiative. The authoress discusses the existing and proposed legal regulations regarding the legislative initiative at the level of the voivodship self-government. She analyses the wording of the statutes of individual voivodships, which constitute a source of information on the lists of entities having a legislative initiative in individual voivodships, as well as presenting the bill presented by the President of the Republic of Poland on cooperation in territorial self-government supporting local and regional development, as well as the amendment of certain acts. Anna Wierzbica Legal position of a Chairperson and Deputy Chairperson of a municipal (county, voivodship) council ..........................................................................................................................75 Each legislative body is responsible for selecting the Chairperson and Deputy Chairperson of the Council. Although the legal regulations regarding the legal status of the people managing the municipal, county or voivodship council have existed since the beginning of the functioning of the systemic acts on self-government, they still give rise to doubts. This applies, in particular, to the procedures of appointing and dismissing the chairperson of the council and the possible right of candidates to the position in question or people being dismissed from them to participate in this procedure. The authoress points out that the legal nature of a resolution of the legislative body, the subject matter of which is the acceptance of the resignation of the Chairperson or the Deputy Chairperson of the council, is unclear. Samorząd Terytorialny 1–2/2016 189 TA B L E O F CO N T E N T S & A B S T R A C T S Małgorzata Mędrala Comments on the special protection of the employment of councillors ............................................87 In the article, the authoress discusses the interpretation problems related to the statutory requirement for the employer to obtain prior consent from the legislative body of the territorial self-government for the termination of a councillor’s employment. The provisions of the systemic Acts provide that the council shall refuse to give its consent to the termination of employment of a councillor, if the grounds for terminating such employment are events related to performance of the mandate by the councillor. The authoress asks about the extent of freedom of the respective authorities for giving consent to the termination of a councillor’s employment, analysing three groups of views. The authoress takes the view that the body is only obliged to refuse to give its consent to the termination of a councillor’s employment if the grounds for the termination are events related to the performance by the councillor of his mandate, whereas, in other cases, it is required to give its consent after determining that the dismissal has a different background than the performance of the mandate. Monika Augustyniak Internal organization and the functioning of commissions in the legislative bodies of municipalities, counties and voivodships in Poland and France. Selected issues ......................... 98 In the article, the authoress presents the internal organization and forms of operation of commissions of the legislative bodies of territorial self-government units in the Polish and French legal orders. The legislative bodies of municipalities, counties and voivodships exercise authority at local and regional level through the appointment of substantively specialized groups for implementing specific tasks, referred to by an Act or the statutes of the given unit. The commissions of the legislative bodies, both in Poland and in France, are collegial bodies, which have powers of an advisory and consultative, legislative, control and settling nature for instance in simplified complaint proceedings. All the considerations have been presented in the light of the case law of the administrative courts. Grzegorz Maroń ”Non-binding resolutions” of the legislative bodies of territorial self-government units using the example of resolutions regarding bioethical issues ..........................................................................111 A non-binding resolution is one of the categories of resolution passed by the legislative bodies of territorial self-government units in order to articulate a position in cases related to the current activity of that body, as well as activities which are socially significant and constitute the subject-matter of a current public debate. Most frequently, the author of the non-binding resolution refers in it to specific public authorities or other entities, or possibly the entire self-government community to take appropriate steps to implement the state of affairs expected by the council. Non-binding resolutions are non-governing forms of activity of the bodies of territorial self-government units; they are neither normative acts (universally or internally binding), nor a classic act of applying the law, which means that they do not formulate general and abstract norms. As an example, the author discusses resolutions on bioethical issues, such as abortion, euthanasia or in vitro. Dorota Wilkowska-Kołakowska The role of property valuers and surveyors in real property management in the municipality ....127 The legal and factual activities related to real property management in the municipality performed by a surveyor and property valuer encompass not only support for the municipal housing stock, but also participation in administrative proceedings being handled by the municipality regarding properties located within the municipality. Therefore, it is very important to ensure that the experts performing these tasks are of an appropriate technical and ethical level. According to the authoress, this can contribute to the establishment of professional associations of property valuers and surveyors and the statutory definition of the principles of cooperation between the professional association of specified professions and the municipal self-government. Paweł Daniel, Arkadiusz Skomra The possibility of overruling a final administrative decision issued in a demarcation case ............139 The objective of the article is to establish the circumstances in which it is possible to file a petition to overrule a final administrative decision issued in a demarcation case. The studies performed by the authors indicate that the possibility only applies to such decisions, with respect to which petitions for a court of general jurisdiction to hear a case were not filed effectively and hence decisions arising from the petition of the party which is dissatisfied with the demarcation, which have not lost their legal force in view of the court issuing a decision. Monika Zakrzewska The role of the executive bodies of municipalities in resolving conflicts of interest related to the construction of regional municipal waste processing plants using the example of the construction of a waste incineration plant ...................................................................................150 The article presents the issue of conflicts of interest related to the executive bodies of municipalities issuing investment permits for the construction of regional municipal waste processing plants. Municipal self-governments are responsible for ensuring the construction, maintenance and operation of these installations, as well as for the achievement of appropriate levels of recycling, preparation for re-use and recovery using other methods, as well as the reduction in the mass of biodegradable municipal waste transferred for disposal. Therefore, it should be accepted that the support teacher performs his tasks specified for positions with different weekly obligatory working times.
