WARUNKI PRZYJMOWANIA TEKSTÓW DO DRUKU
Redakcja przyjmuje teksty oryginalne o objętości 25–40 tys. znaków, z wyraźnie zaznaczonym tytułem, podziałem na podrozdziały, podsumowaniem, przypisami, krótką notką o autorze oraz adresem
e-mailowym. Materiały większe lub mniejsze albo już publikowane wymagają osobnej zgody Redaktora
Naczelnego. Wymagania co do wielkości tekstu nie dotyczą polemik, glos, sprawozdań, recenzji itp.
Tekst należy również zaopatrzyć w abstrakt w języku polskim, o objętości nie większej niż 500 znaków.
Autor może zaproponować tłumaczenie na język angielski tytułu tekstu oraz abstraktu, a także podać
adres e-mailowy w celu publikacji. Przypisy powinny być opracowane w tradycyjny sposób – na dole
strony. Dopuszczalny jest również wykaz wykorzystanej w tekście literatury. Materiały wraz z danymi
autora (stanowisko, adres, numer telefonu) i ewentualnym listem polecającym prosimy przysyłać pocztą
elektroniczną lub zwykłą, z załączoną płytą CD.
Przekazując tekst do redakcji, autor przenosi na Wydawcę wyłączne prawo do jego publikacji. Nie drukujemy artykułów o charakterze opisowym, pozbawionych aspektu badawczego lub nowych treści interesujących poznawczo. Autor ponosi odpowiedzialność za aktualny stan prawny, orzecznictwa i doktryny.
Redakcja zastrzega sobie prawo skracania tekstów, zmiany tytułów, śródtytułów oraz poprawek merytorycznych i stylistycznych, również w wersji angielskiej. Materiałów niezamówionych nie zwracamy.
Warunkiem publikacji tekstu jest odesłanie uprzednio podpisanej umowy z Wydawnictwem.

Systemic position of the Joint Commission of the Government and Territorial Self-Government .... 7
The Joint Commission of the Government and Territorial Self-Government has been operating for 20 years. The Commission has had full statutory
capacity since 2005. Previously, since 1997, the legal grounds for its operation were contained in a regulation of the Council of Ministers issued
under the authority of the Act on the Council of Ministers. Despite the initial shortcomings in its legitimacy, from the beginning, it has been a tool
of dialogue between the government and representatives of the spontaneously organized self-government environment, as well as the manifestation of the cohabitation of the government expressing the interest of the state and the politically differentiated territorial self-government,
expressing regional and local interests. The author, guided by the constitutional status of territorial self-government, describes the Commission’s
current systemic position as the position of a tool for cooperation of these two distinct types of public authority as a part of the executive authority.

Municipal (city) wardens and the protection of public order ................................................................. 21
Municipal wardens operate in Poland under the Act of 1997. The justification for creating the warden function is derived from the sphere of municipal self-government activities, which impose public order and civic safety obligations on the municipality. The decision to form the municipal
warden service lies within the responsibilities of the municipalities which finance its operation. In a situation where the municipal authorities come
to the conclusion that the warden service is dysfunctional, the municipal council is also responsible for liquidating this service. The authoress
emphasizes that the over 15 years of existence of municipal (city) wardens indicates that they have become a part of the local landscape, which
does not mean, however, there are no situations of conflict, problems in responsibility or problems with social legitimacy of the activities of the
wardens. From the self-government point of view, they are a valuable solution, although institutional changes to which they are subject and those
planned for the future should be remembered.

Prospects for the development of Euroregions in the Polish-Slovakian border regions................... 34
In this article, the author describes prospects for the development of Euroregions in the Polish-Slovakian border regions – the Carpathian, Tatra
and Beskid mountains. The considerations in the first part of the article refer to the essence of territorial cooperation and the conditions of Polish-Slovak cooperation, as well as the changes planned by the European Union in financing territorial cooperation in the budget for 2014-2020.
Next, the author analyses the proposals for institutional and legal transformations of the Euroregions studied. Particular attention is drawn to
the new EU legal initiative – the European groupings of territorial cooperation (EGTC). Then, he describes the Tatra and TRITIA EGTCs, which are
currently being formed, and describes his proprietary initiative of the Carpathian Euroregion – “Carpathian Horizon 2013”.

Application of the state action doctrine to municipal self-government activities

One of the problems of anti-monopoly law is the extent of its applicability to the activities performed by the state. The essence of the state action
doctrine is the specification of when the state can take steps which limit competition. One of the areas of application of the state action doctrine
is that of the activities of municipal self-government in the provision of public services. The article presents the development and evolution of the
doctrine in the case law of the Supreme Court of the United States and the Court of Justice of the European Union and indicates the problems of
its application under the Act on competition and consumer protection, which is applicable in Poland. The author presents the position that the
protection of competition is not an absolute value, while the protection of the public interest can justify equipping municipal councils with powers
leading to the limitation of competition.

The issue of bodies of territorial self-government as bodies of the public administration is frequently mentioned in the legal doctrine and in practice. The status of this category of bodies as enforcement bodies is presented far less frequently. Therefore, this issue is a subject of interest to the
authoress, who restricts her considerations in the article to the municipal body with powers in the administrative enforcement of both cash and
non-cash obligations. In analysing the legal solutions, which apply to this, the authoress draws attention to the need for change because of the
practical problems which frequently arise on their basis.

The nomination of a candidate to an audit commission is actually a right and not an obligation of a party, although local councillors from a party,
as representatives of the residents of a county (municipality) acting in the public interest, should exercise this right. However, if the party of the
councillors does not exercise the rights which it is guaranteed by Article 16, para. 2 of the Act on the County Self-Government (Article 18a, para.
2 of the Act on Municipal Self-Government) and refuses to nominate its representative to the audit commission, this commission should be appointed by the county (municipal) council, omitting the representative from that party. This is because the failure of the party of the councillors to
exercise the statutory right to nominate their representative to the audit commission cannot prevent the formation of the commission and lead to
the paralysis of the work of the county (municipal) council.
